A federal judge who temporarily blocked President Donald Trump’s bid to rapidly deport Venezuelan gang members via the 18th century Alien Enemies Act is facing an impeachment push.
Just after the judge’s temporary order was issued, Representative Brandon Gill (R-Texas) announced plans to file articles of impeachment against the judge, which garnered praise from Tesla founder Elon Musk.
“Necessary,” Musk wrote on X after Gill revealed his plans to introduce articles of impeachment against the judge.
“The very worst judges – those who repeatedly flout the law – should at least be put to an impeachment vote, whether that vote succeeds or not,” Musk followed up in a separate post on X Monday.

Many are asking if federal judges can be impeached as a consequence of judicial activism, deciding a case based on their personal preferences rather than what is stated in the Constitution, statutes, and applicable precedent and in usurpation of legislative and executive power. The answer is yes.
A series of extreme and activist decisions against President Donald Trump’s constitutional authority exercised through the Department of Government Efficiency and his appointees such as Elon Musk have brought the question to the fore.
But Article II, Section 1, Clause 1 of the Constitution unambiguously states, “The executive Power shall be vested in a President of the United States of America.”
In explaining what’s also known as the “vesting clause,” White House deputy chief of staff Stephen Miller said,
* “A president is elected by the whole American people. He’s the only official in the entire government elected by the entire nation.
* Judges are appointed. Members of Congress are elected at the district or state level.”
As Miller put it, “The threat to democracy — indeed, the existential threat to democracy — is the unelected bureaucracy of lifetime, tenured civil servants who believe they answer to no one, who believe they can do whatever they want without consequence, who believe they can set their own agenda no matter what Americans vote for.”

Attorney General Pam Bondi has unleashed a blistering emergency motion with the U.S. Court of Appeals for the D.C. Circuit, demanding an immediate stay of an “outrageous overreach” by Obama-appointed District Judge James E. “Jeb” Boasberg.
The motion, filed early Saturday morning, accuses Boasberg of sabotaging the Trump administration’s national security agenda by issuing an “unauthorized” Temporary Restraining Order (TRO) that blocks the removal of dangerous illegal aliens tied to the notorious Venezuelan gang Tren de Aragua (TdA)—a designated Foreign Terrorist Organization (FTO).
The explosive filing accuses Boasberg of acting without jurisdiction, without evidence, and without even hearing from the government—rushing to issue a 14-day TRO just hours after five anonymous Venezuelan plaintiffs filed a class-action complaint.
These plaintiffs, detained in Texas, claim they fear being wrongly swept up in Trump’s rumored plan to invoke the Alien Enemies Act (AEA) to expel TdA members.
