Under what conditions can the president invoke the Alien Enemies Act?
The president may invoke the Alien Enemies Act in times of “declared war” or when a foreign government threatens or undertakes an “invasion” or “predatory incursion” against U.S. territory. The Constitution gives Congress, not the president, the power to declare war, so the president must wait for democratic debate and a congressional vote to invoke the Alien Enemies Act based on a declared war. But the president need not wait for Congress to invoke the law based on a threatened or ongoing invasion or predatory incursion. The president has inherent authority to repel these kinds of sudden attacks — an authority that necessarily implies the discretion to decide when an invasion or predatory incursion is underway.

BOSTON — Federal authorities say they deported a Lebanese doctor holding an American visa last week after finding “sympathetic photos and videos” of prominent Hezbollah figures in a deleted items folder on her cell phone.
Rasha Alawieh, a physician specializing in kidney transplants and professor at Brown University, also told Customs and Border Protection agents that while visiting Lebanon last month she attended the funeral of Hezbollah leader Hassan Nasrallah and followed his teachings “from a religious perspective” but not a political one, according to an official report on her interrogation by an immigration officer.

In a major victory for national security and law enforcement, the Trump administration has successfully deported over 250 violent gang members back to El Salvador, removing dangerous criminals from American communities and ensuring they face justice in their home country. Among those deported were 238 members of Venezuela’s Tren de Aragua gang and 23 members of the notorious MS-13—both groups known for their involvement in drug trafficking, human smuggling, and brutal violence.

The operation faced resistance from left-wing activists when U.S. District Judge James Boasberg attempted to block the deportations with a last-minute court order. Donald Trump said on Monday that the arrest of a prominent Palestinian activist who helped lead Columbia University’s pro-Palestinian protests last year, was the “first arrest of many to come”.
“We know there are more students at Columbia and other Universities across the Country who have engaged in pro-terrorist, anti-Semitic, anti-American activity, and the Trump Administration will not tolerate it,” the US president wrote in a post on Truth Social.

I was just informed that two repatriation flights from the United States, with a large number of Illegal Criminals, were not allowed to land in Colombia. This order was given by Colombia’s Socialist President Gustavo Petro, who is already very unpopular amongst his people. Petro’s denial of these flights has jeopardized the National Security and Public Safety of the United States, so I have directed my Administration to immediately take the following urgent and decisive retaliatory measures:

 -Emergency 25% tariffs on all goods coming into the United States. In one week, the 25% tariffs will be raised to 50%.

-A Travel Ban and immediate Visa Revocations on the Colombian Government Officials, and all Allies and Supporters.

-Visa Sanctions on all Party Members, Family Members, and Supporters of the Colombian Government.

-Enhanced Customs and Border Protection Inspections of all Colombian Nationals and Cargo on national security grounds.

-IEEPA Treasury, Banking and Financial Sanctions to be fully imposed.
 
These measures are just the beginning. We will not allow the Colombian Government to violate its legal obligations with regard to the acceptance and return of the Criminals they forced into the United States!
